Who is Eligible for Serbian Citizenship by Descent?
Serbian nationality law, like many other European countries, is primarily based on the principle of jus sanguinis, which is literally the right of blood. Article 23 of the Serbian nationality law states that foreigners of Serbian descent have the right to acquire Serbian nationality by making a written request. Also, the Law stipulates that dual nationality is allowed, allowing a person the right to retain their current nationality and obtain Serbian citizenship. Furthermore, thanks to amendments made in 2007, ethnic Serbian citizens residing outside Serbia have the right to citizenship.
Citizenship Law of the Republic of Serbia, in article 7, establishes that it is acquired by descent if:
- Both parents were Serbian citizens at the time of your birth.
- You were born in the territory of Serbia and your father was a Serbian citizen at the time of your birth.
- You were born abroad, and your father was a Serbian citizen at the time of your birth, while the other parent was unknown, of unknown citizenship, or stateless.

If your ancestor emigrated from Serbia, your descendants may be eligible to apply for citizenship of the Republic of Serbia if they have reached the age of 18, are fit to work, and provide a written declaration stating that they consider the Republic of Serbia their homeland. (Article 18 of the Law on Serbian Citizenship).
Spouses of the individuals who acquired Serbian citizenship under Article 18 can also acquire citizenship of Serbia if they submit a written statement declaring that they consider Serbia their state.
