Schedule B – Consultant and Client Expectations
The relationship between EuroPassport and the Client must be built on trust, confidence and respect. To that end, the parties agree as follows.
1. Expectations of Clients: EuroPassport expects the highest degree of integrity and ethical conduct from the Client. The Client understands this expectation and agrees:
- .1 Document Verification: To provide the names, family history details, along with complete and accurate copies of Lineage Documents (as defined above in Section 1.1 (Family History Documents) of Schedule A – Scope of Work) as requested by the Consultant. These documents are required to enable the Consultant to verify the Client’s family details, provide the Services, and maximize the probability that the Client’s application for Citizenship by Descent will be successful;
- .2 Genealogical Research and Eligibility Screening: Cooperating with EuroPassport, the European Lawyer, the genealogist, and any other Third Party Contractors (as defined above in Section 3 (Outside Experts) of Schedule A – Scope of Work) as required to support additional genealogical research, obtain additional Lineage Documents, and establish whether the Client is eligible for Citizenship by Descent;
- .3 Previous Applications: To supply the Consultant with any details about any previous applications for citizenship in Europe (including applications for Citizenship by Descent), and whether those applications were successful. If they were not, then to supply details about why they were not successful, along with the contact information for any European Lawyers that were involved;
- .4 Honesty: To honestly, accurately and completely answer all questions from EuroPassport in connection with the application for Citizenship by Descent;
- .5 Non-Disclosure: To refrain from sharing with anyone any emails, letters or other solicitor/client privileged items from the European Lawyer except other professional advisors or other individuals having a need-to-know such information;
- .6 Active Listening: To listen to any advice provided by the Consultant or the European Lawyer, even if the Client disagrees with that advice. And, to provide open and honest feedback about the advice and why it may or may not work in the circumstances;
- .7 Bills: To pay any bills in connection with the Services, including the Price as set out in the Pricing Documents. The Client acknowledges that EuroPassport will bill them in stages as they progress through the steps needed to complete the application for Citizenship by Descent. Each billing stage is independent and builds on the previous one. In circumstances where a stage is taking more time than initially anticipated, the Client acknowledges that EuroPassport will not be able to move to the next stage. Moreover, EuroPassport may encounter situations that require it to move back to a previous stage (such as, by way of example, missing Lineage Documents that need to be located). In circumstances where it encounters an unforeseen delay that renders it unable to progress, EuroPassport reserves the right to determine, in its reasonably exercised discretion, that the Services have been fully rendered. Thereafter, EuroPassport may bill the Client for all work provided to date as contemplated in the Pricing Documents;
- .8 No False Information: To never, under any circumstances, mislead EuroPassport staff or the European Lawyer, or knowingly provide those individuals with false information or intentionally withhold any relevant information concerning the application for Citizenship by Descent; and
- .9 No Micromanagement: So long as EuroPassport provides the Services pursuant to this Agreement, to permit EuroPassport to complete work in such manner as it sees fit without interference or control by the Client. This includes allowing EuroPassport to determine what documents are relevant to the mandate, which Third Party Contractors to retain and which EuroPassport staff members ought to be assigned to work with the Client.
2. Expectations of EuroPassport: When carrying out the Services, the Consultant will provide one or more qualified and competent individual(s) to provide the Services to a first-class professional standard while exercising the care, diligence and skill of a reasonably prudent person. This shall include:
- .1 Using qualified, experienced, competent and skilled individuals for the provision of the Services;
- .2 At all times behaving honestly and ethically with due regard for the privacy, safety, health and well-being of those around;
- .3 Refraining from publicly insulting, disparaging or otherwise speaking negatively about the Client;
- .4 Rendering the Services in accordance with this Agreement (including Schedule E – Confidentiality/Privacy) along with its privacy policy and other documents governing the collection, use, retention, processing, and disclosure of the Client’s personal information (including Lineage Documents) as set out on the EuroPassport Website; and
- .5 On a best-efforts basis and as may be feasible (all as determined by the judgement of the Consultant) tailoring the Services based on the needs of the Client.
The Consultant will continue to work with Client to shape the Services in an effort to best achieve the desired outcomes, including obtaining Citizenship by Descent. However, as long as the Consultant provides the Services in accordance with the standards above, it will be free to provide the Services in such manner as it sees fit.
