What is Belgian Citizenship by Descent?

Belgian citizenship by descent refers to the process of acquiring Belgian nationality through family ancestry. In Belgium, there is the possibility of obtaining citizenship if a direct link can be proven with a Belgian citizen. To be eligible for Belgian citizenship by descent, it is generally required that at least one parent or grandparent be a Belgian citizen at the time of the applicant’s birth.

You should also know that a birth certificate from the ancestor is not enough to prove citizenship. At least one passport from the ancestors is also required, and ideally other documents to prove citizenship. Who is Eligible for Belgian Citizenship by Descent?

This will depend on the date of your birth. There are a number of scenarios that could qualify you for citizenship:

  1. If you were born before January 1, 1967 and:
  • You are the legitimate child of a Belgian father, or
  • You are the son of a Belgian mother and an unknown father; if the father was a foreigner, it implies the loss of nationality.
  1. If you were born between January 1, 1967 and December 31, 1984 and:
  • You were born in Belgium to at least one Belgian parent, or
  • You were born abroad as the legitimate child of a Belgian father, or
  • You were born abroad to a Belgian mother and she was born in Belgium, or in the Belgian Congo before June 30, 1960, or in Rwanda or Burundi before July 1, 1962.
  1. If you were born after January 1, 1985, and:
  •  You were born in Belgium to at least one Belgian parent
  •  You were born abroad and:
  1. Your father or mother was born in Belgium, or in the Belgian Congo before June 30, 1960, or in Rwanda or Burundi before July 1, 1962, or
  2. Your Belgian father or mother was born abroad and made a declaration requesting Belgian citizenship when you were under five years of age.

You will only need to pay taxes in Belgium if you move and live there at least 6 months of the year. If you move to another EU member country, you may not have to pay taxes in Belgium, but you may still have to pay taxes in the European country in which you decide to live, so you would need to consult with the local tax authorities in that country.
