Schedule A – Scope of Work
1. Scope: EuroPassport shall utilize its expertise to assist the Client in an application for Citizenship by Descent by doing the following work for the Client:
- .1 Family History Documents: Consulting with, and directing, the Client on any documents required to support the application for Citizenship by Descent including (without restriction) birth certificates, residency documents, passports, citizenship documents, genealogical records of the Client’s family, and similar documents (“Lineage Documents”);
- .2 Genealogical Research: Where the Lineage Documents supplied by the Client are insufficient to support the Citizenship by Descent application, EuroPassport may retain, on the Client’s behalf, the services of a genealogist (who will be a Third Party Contractor as defined below in Section 3 (Outside Experts)) for the purposes of undertaking genealogical research on the Client’s family history. EuroPassport will work with that genealogist to, on a best efforts basis, obtain such additional Lineage Documents as required to support the application. The Client acknowledges that services in this paragraph are qualified as set out in Sections 4.1 (General Disclaimer – No Guarantee of Citizenship) and 4.4 (General Disclaimer – Missing Lineage Documents) of Schedule G – General Terms. EuroPassport does not guarantee that any Lineage Documents will be located. In circumstances where Lineage Documents are missing, EuroPassport may modify the Pricing Documents to add a proposal for more extensive genealogical research as needed. Where EuroPassport determines, in its reasonably exercised discretion, that any required Lineage Documents are missing and unable to be located, the services herein will be considered fully rendered. EuroPassport will return any original paper Lineage Documents in its possession to the Client.
- .3 Eligibility Assessment: Where so required, submitting Lineage Documents to the European Lawyer for the purpose of assessing whether the Client will be eligible for Citizenship by Descent, and obtaining from that lawyer a written report with recommendations (if any) on how to move forward. For clarity, where the European Lawyer determines that the Client is ineligible for Citizenship by Descent and unable to proceed, the Services will be considered fully rendered.
- .4 Application Forms: Assisting the Client in obtaining and filling any forms required as part of the application for Citizenship by Descent, along with assisting the Client in preparing any supporting documents required for the application such as (without restriction) curriculum vitaes and reference letters.
- .5 Translations: Retaining on behalf of the Client a language translator where a translation of any Lineage Documents is necessary to support the application for Citizenship by Descent. This translator will be a Third Party Contractor as defined below in Section 3 (Outside Experts).
- .6 Authentication: Authenticating any Lineage Documents as required by the government authorities processing the Client’s application for Citizenship by Descent by a notary public, apostille, or similar official in any jurisdiction involved in the application;
- .7 Background Checks: Assisting the Client in obtaining any criminal background checks, or similar investigations, as required to support the application for Citizenship by Descent;
- .8 European Lawyer: Retaining and working with a European Lawyer when applicable as contemplated in Section 5 (European Immigration Lawyer) of the cover page of this Agreement above. Where so required, assisting that European Lawyer in submitting the application for Citizenship by Descent along any authenticated Lineage Documents.
- .9 Guidance on Direct Submissions: For jurisdictions where the Client must submit the application for Citizenship by Descent directly to a consulate or other government body, guidance and instructions to the Client on how to apply. The Client acknowledges that the services in this paragraph are qualified as contemplated in Sections 4.1 (General Disclaimer – No Guarantee of Citizenship) and 4.3 (General Disclaimer – Changes to Laws) of Schedule G – General Terms. The Client acknowledges despite the best efforts of all the parties involved EuroPassport does not guarantee that the application will be accepted by the government body.
- 10. Paying Third Parties: Collecting from the Client as part of the Price, any fees payable to any government authority, the European Lawyer, any outside expert (including genealogists), or any agency in connection with the application for Citizenship by Descent and remitting those fees as required;
- .11 Communications: Facilitating communications between the Client, the European Lawyer, the experts, the government agencies, and any other parties involved in preparing and processing the application for Citizenship by Descent. This specifically includes follow-up messages to ensure that the Client is moving through the application process at a reasonable rate, with the intent to obtain Citizenship by Descent within a reasonable period of time. It also includes reporting to the Client on the status of the application from time to time.
- .12 Citizenship Documents: Where the application for Citizenship by Descent is successful, then if sent to EuroPassport directly then obtaining the citizenship documents and delivering them to the Client by courier.
2. Additional Family Members: The parties acknowledge that, in addition to obtaining Citizenship by Descent for themselves, the Client may also direct EuroPassport to prepare applications for one or more members of the Client’s family. In such circumstances, the Price will be adjusted accordingly to account for the additional Services, and the Pricing Documents will specifically include references to both the Client and the Client’s family members. In this Agreement, where the context so requires, the term Client shall be construed to specifically include the Client and said family members.
3. Outside Experts: From time to time, at any time, for so long as this Agreement remains in force, EuroPassport may retain the services of one or more third party experts or other independent contractors to assist it in providing the Client with the Services including (without restricting) the services of genealogists, translators, notaries, commissioners, authentication and apostille service providers, couriers, technology providers, document retrieval agents, payment processors, passport and citizenship service providers, and the European Lawyer (“Third Party Contractor(s)”). The Client hereby consents to EuroPassport using said Third Party Contractor(s) and agrees to permit them access to the Lineage Documents and other Client Data reasonably required for citizenship and passport services. The Client also acknowledges that Third Party Contractors are independent professionals and are not employees, agents, partners, or authorized representatives of the Consultant, except where expressly stated otherwise in writing. The Consultant does not control the manner in which such Third Party Contractors perform their professional work.
